iLawsuit: First iPhone lawsuit is filed and it’s an iLoser

Plaintiff Jose Trujillo was thrilled to get his iPhone, not because he was now able to use the cool new sleek device, but because he could try and make a quick buck suing the deep pocketed creators of it:

Unknown to the Plaintiff, and undisclosed to the public, prior to purchase, the iPhone is a sealed unit with its battery soldered on the inside of the device so that it cannot be changed by the owner.

The battery enclosed in the iPhone can only be charged approximately 300 times before it will be in need of replacement, necessitating a new battery annually for owners of the iPhone.

It appears that besides being a litigious consumer, Jose Trujillo isn’t a very good reader. A quick scanning of press around the time of release was harping on the battery issue. Once again instead of voting with his wallet and simply not buying the device (or taking it right back once he opened it), someone tries to short-cut the market process by putting their class action lawyer on speed dial. Of course that is probably being too generous to Trujillo who is likely just trying to extort a few iDollars from Apple and AT&T. Let’s hope they give him and his legal team the slamming that they so deserve.
