Bad Parenting: You put your kid in a trash bin; Holly Ashcraft Returns

Holly Ashcraft, the 22 year old suspended USC student who was arrested last October after her new born baby was found in a trash bin outside her apartment near campus will finally stand trial on suspicion of murder and child endangerment.

    Holly Ashcraft Update: Her Baby Was Murdered

In the most recent development:

At a hearing to determine whether there was sufficient evidence to bring her to trial, Los Angeles County Superior Court Commissioner Ronald Rose held that the law “requires parents to provide treatment and care” to a newborn, and failure to do so can be the basis for a murder trial.

You would think that this would be an open and shut case, but like Michael Jackson and Scott Peterson, Ashcraft has hired Mark “nothing-is-too-stupid-to-say” Geragos. Despite the indisputable fact that the baby was tossed into into a trash dumpster would count as failing “to provide treatment and care,” Geragos claims that the baby’s death was “not an intentional act.” Most people would disagree.

Second, despite the fact that the medical examiner who performed the autopsy has already determined that the death was a homicide (caused by prematurity and other, unspecified factors), Geragos’s second defense is that the baby was not born alive, thus it couldn’t have been homicide since you can’t kill something that’s already dead. In other words, his best case is that Holly, a woman previously suspected of infanticide, delivered a stillborn baby by herself, in her apartment, then wrapped up the dead baby in a cardboard box, wrapped it up tightly with packing tape, tossed in the dumpster behind her apartment and waited for a homeless guy to find the body. That’s sick and remember that’s her excuse, the truth is far, far worse. Even if her version were somehow true, which is highly unlikely, what was she doing trying to deliver a baby herself as opposed to going to a hospital or calling 911? So much for “providing treatment and care” as required by law.

Of course the headline-grabbing Geragos is just doing his job, but he really does have the ability to pick remorseless child molesting, child killing and wife killing clients.

The last time this story was a hot discussion topic we had some of her USC friends telling us what a great girl she is, etc. Sorry, good people don’t toss their sons in trash bins. End of story.

    Wow, that is incredibly sick. That’s definitely a case that should be opened and closed in minutes. In Washington State, a mother can drop off a baby at a fire station, hospital, clinic, etc. and not face any legal prosecution (I’m guessing it’s more-or-less the same as the Cali law after reading one of your previous posts). Even if our nation disagrees on abortion, we should all be able to agree that giving birth and “trashing” the baby is MURDER.

    If you follow the links above you’ll see that CA has the same law (Safe Surrender) and fire station drop off point was a 42 second drive from her house. She had every opportunity not to murder the baby but for reasons that only she knows it was easy to treat it like a recyclable. Sick beyond belief.
