Mark Karr and the Stupid Things Defense Attorneys Say

Defense attorneys almost always advise their clients to remain silent. Why can’t they follow this advice themselves?

Karr’s Colorado public defender, Seth Temin commenting on the news that his client Mark Karr would not be charged in the murder of JonBenet Ramsey:

“We’re deeply distressed by the fact they took this man, dragged him back here from Bangkok, Thailand, with no forensic evidence confirming the allegations against him and no independent factors leading to a presumption that he did anything wrong.”

Let’s analyze this statement:

Public defender: “…no independent factors…”

Except of course the repeated instances by Mr. Karr that he did in fact commit the crime.

These admissions included email exchanges, phone calls and even an on-camera comment that he’d been with the Ramsey child when she died and that her death was an accident.

“…I cared for her and tried to revive her when I thought she was dead. I loved her so much and I am so sorry that she died in my arms.”


and

“Her and I were engaging in a romantic and very sexual interaction. It went bad and it was my fault.”

Public Defender: “…presumption that he did anything wrong.”

Except of course the fact that he is wanted in California for possession of child pornography from which he fled the U.S. to avoid trial.

For most people, these would count as “doing something wrong.”

Criticizing the DA for arresting a confessing pedophile fugitive without forensic evidence is like criticizing an airline for removing a passenger who claims to have a bomb without independent forensic evidence that they in fact do have a bomb.

Since the public defender wanted to have their day in the sun, Temin should have limited his comments to:

“It appears that my client has been lying all these years about killing JonBenet. He is indeed sick and needs help. Hopefully he’ll get it. In the meantime he’ll soon be off to California to face charges there and be someone else’s problem.”
